Welcome to www.cupofteapsychology.com.au (“Website”). This Website provides you with information about Cup of Tea Psychology (“Business”, “Practice”, “us”, “we”, “our”) and our services, and allows you to communicate with us, exchange information, and book services with practitioners operating at Cup of Tea Psychology (“Services”). The Business and You will collectively be referred to as “Parties,” and each individually as a “Party.”
The Website is operated by Molly White t/a Cup of Tea Psychology (ABN: 77 447 075 162). Access to and use of the Website and any of its associated services is provided by Cup of Tea Psychology. Please read the Terms and Conditions (“Terms”) carefully.
By accessing, browsing, reading, or using the features of this Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of our Services, immediately.
Cup of Tea Psychology reserves the right to review and change any of the Terms by updating this page at its sole discretion. Any changes to the Terms take immediate effect from the date of their publication. Please check back from time to time to review the Terms. The date of the last modification is written at the beginning of the Terms.
Acceptance of the Terms
You accept the Terms by continuing to use, browse, read, or visit the Website. This is binding from the date of access to the Website. Both parties acknowledge and agree that the provisions of the Terms are fair and reasonable, and both parties have had the opportunity to obtain independent legal advice.
Code of Conduct

Privacy
Cup of Tea Psychology takes your privacy seriously. Any information provided through your use of the Website, including while booking or receiving any Services, is subject to Cup of Tea Psychology’s Privacy Policy. Crisis and Emergency Support
Cup of Tea Psychology is not a crisis support service. We cannot guarantee that we will be available to respond to text messages, emails, or other correspondence quickly, and providing immediate crisis support is outside of the scope of the Practice’s Services. Cup of Tea Psychology staff are often with clients, attending to other work-related matters, or not at work, and will not be available to correspond with you promptly.
We care about your wellbeing and will respond to any correspondence we receive from you during a crisis or emergency, but this is unlikely to be in time to meet your need for support or keep you safe. If you or someone you know are:
having strong thoughts of suicide, self-harm, or hurting someone else, or
have self-harmed, attempted suicide, or hurt someone else, or
are very distressed and unable to regulate or calm, or
are experiencing psychosis,
We advise you to contact one of the following crisis/emergency services until you are safe.

Booking Policy
By accessing the Practice’s online booking system (“Booking System”), you agree to the Booking Policy.
To access the Booking System, you are required to complete the appropriate client intake form(s) (“Intake Form”) provided to you by us. Using your personal information obtained from the Intake Form, a client file (“File”) will be created within our practice management software (“PMS”) that connects to the Booking System. You will then be provided with login credentials to access the Booking System.
When using the Booking System to book a Service, you are responsible for the associated service fees (“Fees”) for the Services that you book. By booking a Service, you are agreeing to the billing and cancellation/rescheduling policies of Cup of Tea Psychology (“Billing Policy”; “Cancellation Policy”).
By using the Booking System, you agree to only book Services that you have genuine intent to attend and pay for.
Cancellation Policy
We understand that circumstances change, and you may need to cancel or reschedule a Service. If you need to cancel or reschedule a Service you have booked, please contact hello@cupofteapsychology.com.au or respond to your appointment reminder SMS with 2 business days’ notice. The following cancellation fees apply:
For NDIS participants:
non-attendances or cancellations with less than 2 business days’ notice are subject to a cancellation fee equal to the full session fee.
For all other clients:
non-attendances or cancellations with less than 2 business days’ notice but greater than 1 business days’ notice are subject to a cancellation fee equal to half of the session fee.
non-attendances or cancellations with less than 1 business days’ notice are subject to a cancellation fee equal to the full session fee.
If we are able to fill the appointment time with another billable service, the cancellation fee will not be charged.
If you have not arrived (for face-to-face Services) or have not logged on (for telehealth Services) at the scheduled start time, we will contact you via SMS. If we have received no correspondence within 15 minutes of the start time of an appointment, the appointment will be considered a non-attendance, and you will be charged for Service. You acknowledge that it is your responsibility to ensure that your contact details are kept up to date for this purpose.
If you repeatedly use the Booking System to book Services which are subsequently cancelled, your access to the Booking System may be restricted and you may need to directly book Services with your practitioner.
If your Cup of Tea Psychology practitioner is no longer able to provide the Service, you will be informed as soon as possible. You and your practitioner can agree to reschedule or entirely cancel the service. You will not be charged a cancellation fee.
You agree that if you appear to be under the influence of substances during the session or behave in a way that is deemed to be unsafe, violent, or aggressive, the appointment will immediately be cancelled, and the full appointment Fee will be retained by Cup of Tea Psychology. This may lead to no further Services being offered.
Rebates
To access Medicare rebates (“Medicare Rebate”) for psychological services, you are required to obtain a referral and any appropriate corresponding plan (“Plan”) from your doctor (“GP”) or specialist such as a psychiatrist or paediatrician. The referral must be in accordance with Medicare requirements including specifying the valid number of services and reasons for the referral.
Cup of Tea Psychology will only process valid Medicare Rebates with all necessary documentation provided. Medicare Rebates will be processed following both the provision of the Service and the payment of any Fees for the Service. You may opt to claim the rebate directly through Medicare instead; Cup of Tea Psychology will provide you with an appropriate receipt following payment of any Fees.
You may be eligible to receive a rebate from your private health insurer. You should contact your insurer directly to confirm whether you are covered. We do not use HICAPS, so you will need to contact your insurer after your appointment to claim any benefits. Cup of Tea Psychology will provide you with an appropriate receipt following payment of any Fees. Please note that if you are receiving a Medicare rebate, you will not be able to claim under private health insurance for the same session.
Copyright and Intellectual Property
The Website, Services, and all the related products of Cup of Tea Psychology are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website, code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes and are reserved by Cup of Tea Psychology or its contributors.
Cup of Tea Psychology retains all rights, title and interest in and to the Website and all related Services. Nothing you do on or in relation to the Website will transfer to you any:
(a) business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright, or
(b) right to use or exploit a business name, trading name, domain name, trade mark or industrial design, or
(c) thing, system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a thing, system or process).
You may not, without the prior written permission of Cup of Tea Psychology, any involved practitioners, and any other relevant rights owners: broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services or third party Services for any purpose, unless otherwise provided by these Terms. This prohibition does not extend to materials on the Website, which are freely available for re-use or are in the public domain.
General Disclaimer
Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.
Subject to this clause, and to the extent permitted by law:
all terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and
Cup of Tea Psychology will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms (including as a result of not being able to use the Services or the late supply of the Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise. This includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:
(a) failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records,
(b)the accuracy, suitability or currency of any information on the Website, the Services, or any of its Services related products (including third party material and advertisements on the Website),
(c) costs incurred as a result of you using the Website, the Services or any of the products of Cup of Tea Psychology, and
(d) the Services or operation in respect to links which are provided for your convenience.
Use of the Website and the Services is at your own risk. Everything on the Website and the Services is provided to you "as is" and "as available" without warranty or condition of any kind. None of the affiliates, directors, officers, employees, agents, contributors and licensors of Cup of Tea Psychology make any express or implied representation or warranty about any products or referred to on the Website.

Any information, advice, content or documentation provided on the Website or on any other related platform do not constitute psychological, professional, medical or other advice, and are provided for general information and guidance purposes only.
All care is taken in the preparation of the information and published materials on the Website or on any other related platform. Cup of Tea Psychology does not make any representations or give any warranties about its accuracy, reliability, completeness or suitability for any particular purpose.
To the extent permissible by law, Cup of Tea Psychology will not be liable for any expenses, losses, damages (including indirect or consequential damages) or costs which might be incurred as a result of the information being inaccurate or incomplete in any way and for any reason or your reliance on the information, advice or documentation on the Website or on any other related platform.
Limitation of Liability and Indemnity
Cup of Tea Psychology's total liability arising out of or in connection with the Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you OR refunding of the Fees for the relevant Services.
You expressly understand and agree that Cup of Tea Psychology, its affiliates, employees, agents, contributors and licensors will not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This will include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill and any other intangible loss.
You agree to indemnify Cup of Tea Psychology and its affiliates, employees, agents, contributors, third party content providers and licensors from and against:
(a) all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with any content you post through the Website,
(b) any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so and any breach by you or your agents of these Terms, and/or
(c) any breach of the Terms.
Jurisdiction
The Website and Services offered by Cup of Tea Psychology are intended to be viewed and received by residents of Australia. The Terms are governed by the laws of New South Wales, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms will be governed according to the laws of New South Wales.
Severance
If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, only that part will be severed and the rest of the Terms will remain enforceable.
